Capital gains tax mitigation on selling (or gifting) property in Spain

The Olive Press, May, 21. 2020

The Olive Press is a fortnightly English language newspaper directed by Jon Clarke. Voted Spain’s number one expat newspaper and ‘second in the world’, by 27,000 people polled by UK marketing group Tesca. Also dubbed “The best English newspaper in Spain,” according to the UK’s Rough Guide. The Olive Press is the English language newspaper for Spain. Local news, in particular, from the Costa del Sol, Andalucía, Alicante, Murcia and Mallorca, plus national news from around Spain. A campaigning, community newspaper, the Olive Press launched in 2006 and represents the huge and growing expatriate community in Spain – with over 100,000 printed copies monthly, 50,000 visitors a day online we have an estimated readership of more than 500,000 people a month.

The Olive Press has as a distinctive feature from its competitors an editorial line with strong emphasis on investigative journalism, which to my mind is the purest form of journalism. It has no qualms in regularly exposing scammers and boiler rooms along the Spanish coasts.

Tax Authorities Crack Down On Enablers of Tax Fraud

Tax Notes, April, 21. 2020

Tax Notes is a US think tank devoted to analysing domestic fiscal policy. It also branches out to study comparative foreign tax policy.

Journalist Mr. William Hoke kindly interviews for his taxation article Mr. Miguel Angel Vazquez-Gonzalez, an Associate at Larrain Nesbitt Abogados (LNA), along with other prominent Madrid-based law firms.

Tax Notes is a portfolio of publications offered by Tax Analysts, a non-profit tax publisher. It provides comprehensive and impartial coverage of tax news, while its commentary contributes important voices to the discussion and understanding of tax policy.

Founded in 1970, Tax Analysts was created to foster free, open, and informed discussion about taxation. In 1972 Tax Analysts published Tax Notes Federal, its first weekly journal, featuring news, commentary, and analysis on federal taxation. In 1989 Tax Analysts added Tax Notes International, a weekly magazine focused on international taxation. Tax Notes State rounded out the weekly portfolio in 1991. Each magazine offers best-in-class tax commentary and analysis on the latest changes in tax law and policy, as well as on court opinions, legislative action, and revenue rulings.

Tax Notes has continued to innovate through the years, adding the online daily news services Tax Notes Today Federal, Tax Notes Today International, and Tax Notes Today State between 1987 and 1991. Tax Notes also provides several research and reference tools, as well as specialized services focusing on exempt organizations, state tax audit guidance, and international tax treaties.

Spain’s New Mortgage Act stirs up trouble

Spanish Property Insight, September, 21. 2019

Spanish Property Insight is a property information website run by Mark Stücklin (inset photo), author of the Spanish Property Doctor Column in the The Sunday Times (2005-2008), and the book ‘Need to Know: Buying Property in Spain’ published by Collins. SPI is regularly quoted by journalists and the international media as the most authoritative source of independent insider information in English language on the Spanish property market. Its weekly influential newsletter reaches over 50,000 readers, many of which are key players in the industry.

SPI kindly quotes us in one of its recent articles regarding Spain’s new Mortgage Act and the adverse impact it has had in the Spanish mortgage market. As we cared to explain in detail in our June article, this well-meaning law is flawed and overprotective, and has in fact ‘thrown a spanner in the works’ effectively delivering a great blow to the mortgage market, when it was flourishing again.

Excessive hand-holding of borrowers (and consumers) backfires when common sense is idly cast aside by lawmakers: link to SPI article.
